Dear Tom Sneddon,
I woke up today to the news of your passing. Right now, the news have yet to properly break, so I am writing this now, before the Internet erupts with people’s comments – not about you, but about Michael Jackson.
You see, people can’t think of you without also thinking of him. You made sure of that. For twelve years, you dedicated your life to crucifying a man who not only was innocent, but who had never done anything to you. You searched the world to find people who were willing to say he hurt them, not because you believed it to be true but because you wanted it to be true. And you wanted the general public to believe it was true, too. Why? That is the part I have yet to understand. But no matter your reasons, the results were this: an innocent man broken and forever tarnished by your lies and your falsified evidence.
He was never the same after that, you know that? His friends would mention it repeatedly, and we all saw it. That twinkle in his eye that was so evident even at the tender age of eight and that made an entire world fall in love with him…it faded. In fact, I dare say it died completely. He used to move from point A to point B softly, but with a stride, dignity and quiet strength and confidence that turned kings and world leaders into star struck kids in his presence. But after what you put him through in 2005, he even WALKED like he was broken. Like any moment he may fall to the ground because the strength of merely standing up was too much for him to muster. He was a ghost of his former vibrant self and it was evident.
And if we, strangers around the would, could see this, you must have been able to, as well. And I wonder: how does that make you feel? Do you harbor any regret at all, or do you just not care? Are you too busy checking your bank account and feeding your ego by playing God with people’s lives in the courtroom to give a damn? It must be nice, being so focused on yourself. So oblivious and completely unaware of the suffering of others.
Because the truth is, caring about other people is hard work. It’s frustrating, time-consuming, and, to be honest, painful. Being aware of the suffering in the world places an unimaginably heavy weight on your mind, because so much is wrong and so many people are hurting and you don’t know how to stop it because no matter how much you try to help it’ll never be enough. That way? Being cold and selfish is probably a blessing.
But Michael wasn’t like that.
Michael was a warm person, with a heart as vast as the planet he traveled many times over on his mission to heal the world. He gave not only his money, but his time, care, concern, and compassion to millions of people when he could have just sat back and enjoyed his fame. He could have stayed in all those luxury hotels and signed a check or two, but he did not. Instead, he visited dirty hospitals and run-down orphanages where the children were tied to their beds. Walked through thousands of cancer ward doors, arms full of stuffed animals and toys for the struggling kids inside, monitored shipments of aid and equipment, paid for new hospital beds, and demanded that they be immediately installed, or he would not perform that night.
And although these are beautiful things, they are also very tragic. Seeing so much pain everyday…hurts. Michael often cried at the state of the world and, I imagine, probably still felt inadequate in spite of doing more for others than most people do in ten lifetimes. I am sure there were times where he wished it wouldn’t hurt so much. But here’s the thing: it wasn’t about him. Michael recognized fully that whatever he was feeling paled in comparison to the feelings of the sick and impaired human beings that he helped. So he continued, despite his own pain. He was THAT selfless.
When Michel died, the world came to a halt. News broadcasts were interrupted, traffic came to a standstill , and people left their homes and took to the streets as if pulled by some invisible force – or maybe just a desperate need for support and togetherness. They grabbed sheets of cardboard to craft signs of love, or placed balloons and flowers at locations he had visited. Many lit candles in front of framed photos in their living rooms, and celebrities, world leaders, and ordinary people alike poured their hearts out. Shock. Disbelief. Pain. Michael Jackson? Dead. Gone. Forever.
In all countries on all continents, people mourned his passing. No matter race, creed, social status, ethnicity, or origin, people were joined in the process of missing him. This is the impact Michael Jackson had on the world. In a sad twist of fate, his death ended up being the one thing that, at least temporary, ended up unifying people the way he had always worked so hard for in life. For a few short, sweet, glorious hours…the world was as one.
As I search the Internet for a confirmation of your death, so far only local Santa Barbara site Noozhawk has picked the story up. Someone edited Wikipedia; presumably the same people who wrote the short text briefly describing your life and death. Your affiliation to Michael was the only thing they mentioned. Through the eyes of the world, that is what you’re known for – and not even the tabloids; the vultures that were so quick to swipe down on Michael’s misfortune all his life, and before his body was even cold in death, have picked up on the fact that you’re dead yet. The world hasn’t come to a halt. No news casts have been interrupted, traffic hasn’t stopped dead on Times Square. You were here, and now you’re not. That’s it. It’s not making a difference, to anyone. And it should make me happy, should make me gloat and sneer and say look; see how no one gives a damn?
But it just makes me sad. It makes me sad that you spent 72 years on this planet – much more than millions of people get – and you are remembered for nothing but hatred and pain. What a complete waste of time, and what a waste of a life.
The short article in Noozhawk said you died surrounded by your family. I’m glad you got to have that. No one deserves to die alone. It is my hope that you were a better father, brother, son, husband, and friend than you were a District Attorney and a human being, so that the people who were around you in life aren’t going to continue your tirade of hate in death. I hope they loved you. If they did, that means they’re hurting right now. My heart goes out to them. And in the end? I want to thank you. I want to thank you because through your actions, your callousness, and your hate, you have shown me exactly who I do not want to be. You have fueled my need to help the hurting and support the broken, to feel a renewed sense of urgency about the way the world is going. We are running out of time, and we must act now, because none of us never know how log we have. You were lucky; you had seven decades. But I may not.
So, I will turn every day into an active choice: I choose kindness, forgiveness, serenity, and compassion. I choose to lift people up instead if tearing them down, I choose selflessness, and most of all: I choose love, every single time. Michael taught me that.
May you rest in peace, Mr. Sneddon. I hope at last you’re free.

Oggi mi sono svegliata con la notizia della tua scomparsa.In questo momento, le notizie devono ancora essere rivelate correttamente,quindi ti sto scrivendo adesso, prima che Internet erutti con i commenti della gente - non su di te, ma su Michael Jackson.
Vedi, la gente non può pensare a te senza pensare a lui. Hai fatto centro. Da dodici anni, hai dedicato la tua vita a crocifiggere un uomo che non solo era innocente ma che non aveva fatto niente nemmeno a te. Hai cercato il modo di trovare persone che erano disposte a dire cattiverie su di lui e non perché credevi che fossero vere, ma perché tu volevi che fossero vere. E volevi che anche il pubblico credesse che fossero vere. Perché? Questa è la parte che devo ancora capire, ma non m’importano le tue ragioni, il risultato è stato raggiunto: un uomo innocente distrutto e per sempre macchiato dalle tue menzogne e dalle tue prove falsificate.
Lui, dopo, non è stato più lo stesso, lo sai? I suoi amici ne hanno parlato più volte, e lo abbiamo visto tutti. Quello scintillio nei suoi occhi, che era così evidente anche alla tenera età di otto anni e che ha fatto si che il mondo intero s’innamorasse di lui… era sbiadito. In realtà, oserei dire, che era morto del tutto.
Prima aveva l’abitudine di spostarsi da un punto A a un punto B dolcemente, ma con un’andatura, la dignità, la forza pacata e la sicurezza di chi si era trasformato da star a re e leader mondiale che emozionava i bambini solo con la sua presenza. Ma dopo quello che tu gli hai fatto passare nel 2005, anche i suoi piedi sembrava non lo sorreggessero più. In ogni momento poteva cadere per terra perché anche radunare le forze per rimanere in piedi, era troppo per lui. Era il fantasma di se stesso e questo era evidente.
E se noi, estranei di tutto il mondo, abbiamo potuto vedere questo, anche tu sei stato in grado di farlo. E mi chiedo: come ti ha fatto sentire? Hai nutrito qualche rimpianto per tutto questo o non te n’è importato niente? Eri troppo occupato a verificare il tuo conto in banca e ad alimentare il tuo Ego giocando a Dio con la vita delle persone in aula per importartene un fico secco? Deve essere bello essere così concentrati su te stessi, quindi ignari e completamente all'oscuro della sofferenza degli altri.
Perché la verità è che avere cura di altre persone è un lavoro duro. È frustrante e, a dire il vero, in termini di tempo, anche doloroso. Essere consapevoli della sofferenza del mondo pone un peso incredibilmente pesante sulla tua mente, perché ci sono tante persone nel mondo che stanno male e non sai come fermare tutto questo, non sai come fermare la sofferenza e non importa quanto tenti di aiutare, non sarà mai abbastanza. Quindi? Essere freddi ed egoisti probabilmente è una benedizione.
Ma Michael non era così.
Michael era una persona gentile, con un cuore grande come il pianeta che ha viaggiato più volte per la sua missione di guarire il mondo.Egli ha dato non solo i suoi soldi, ma il suo tempo, la cura, la preoccupazione e la compassione per milioni di persone, quando avrebbe potuto starsene seduto a godere della sua fama. Avrebbe potuto alloggiare in tutti quegli alberghi di lusso e limitarsi a firmare un assegno o due, ma non l’ha fatto, ha visitato,invece, ospedali sporchi e orfanotrofi dove i bambini venivano legati nei letti. È entrato in migliaia di reparti di oncologia con le braccia piene di animaletti di peluche e giocattoli per i bambini che lottavano al loro interno,ha supervisionato spedizioni di aiuti umanitari e attrezzature mediche, ha pagato per nuovi posti letto negli ospedali e ha chiesto che fossero installati immediatamente altrimenti non si sarebbe esibito quella sera.
E anche se queste sono cose molto belle, sono anche molto tragiche. Vedere tutti i giorni tanto dolore… fa male. Michael piangeva spesso per le condizioni del mondo e, immagino, sentiva che quello che faceva era ancora insufficiente, che poteva fare di più anche se faceva più di quello che la maggior parte delle persone potrebbe fare in dieci vite. Sono sicura che ci sono stati dei momenti in cui lui ha desiderato di non soffrire così tanto. Ma ecco il punto: non si riferiva a se stesso. Michael ha riconosciuto pienamente che tutto ciò che sentiva impallidiva in confronto ai sentimenti degli esseri umani malati che ha aiutato. Il mondo non ha subito una battuta d’arresto. Le trasmissioni non sono state interrotte, il traffico non si è fermato a Times Square perché sei morto . Tu eri qui e ora non ci sei più. Questo è tutto. Non fa la differenza, per nessuno. E dovrei essere felice, dovrei gongolare e sghignazzare vedendo che a nessuno importa un fico secco?
Tuttavia, semplicemente, sono triste. Mi rende triste il fatto che hai speso 72 anni su questo pianeta - molto di più di milioni dipersone - e verrai ricordato solo per l'odio e il dolore che hai causato agli altri . Che completa perdita di tempo e che spreco di una vita.

Retired Santa Barbara County DA gained notoriety for charging pop star with child molestation, but served in post for 26 years
Tom Sneddon, the hard-nosed former Santa Barbara County district attorney best known for prosecuting pop star Michael Jackson on child-molestation charges, died Saturday in Santa Barbara.
Sneddon, 73, died at Santa Barbara Cottage Hospital with his family at his side, according to Santa Barbara District Attorney Joyce Dudley.
“It is with great sadness that we learned of the death of our former district attorney ... who died today from complications following his cancer diagnosis,” Dudley said in an email to her staff.
Thomas W. Sneddon Jr. was elected to the district attorney’s post in 1983, and served until his retirement in 2010.
On two occasions — in 1993 and 2005 — Sneddon pursued child-molestation charges against Jackson, who lived at Neverland Ranch in the Santa Ynez Valley.
No charges were filed after the 1993 investigation, but the 2005 case went to trial, which drew international attention.
Jackson, who died in 2009, was accused of four counts of molesting a minor, four counts of intoxicating a minor in order to molest him, one count of attempted child molestation, and one count of conspiring to hold the boy and his family captive at his 2,800-acre ranch on Figueroa Mountain Road near Los Olivos.
Sneddon decided to lead the prosecution himself during a trial that drew hundreds of journalists from around the world.
On June 13, 2005, a Superior Court jury found Jackson not guilty on all charges.
Earlier, Jackson took aim at Sneddon in a track on his 1995 double album, HIStory Past, Present and Future, Book 1.
Jackson can be heard singing, “Tom Sneddon is a cold man.”
Fans of Jackson accused Sneddon of having a vendetta against him, an accusation he vehemently denied.
Sneddon, an Army veteran, was raised in California. He earned a bachelor’s degree in history from the University of Notre Dame, and received his law degree from UCLA.
He joined the District Attorney’s Office in 1969, rising through the ranks before being elected to the department’s top spot in 1983.
Sneddon and his wife, Pamela, had nine children.
Dudley told Noozhawk on Saturday night that Sneddon was “a pioneer in many areas of prosecution, especially crimes against vulnerable victims,” noting that he founded the county’s Sexual Assault Response Team.
“He was also a mentor to most of the deputy district attorneys in our county, as well as many DAs throughout our country,” Dudley said.
Funeral arrangements for Sneddon were pending Saturday night.

There isn’t much nice I can say about Tom Sneddon, the former Santa Barbara District Attorney. He is dead at age 73. You’re not supposed to speak ill of the dead. But this is what I know: Sneddon conducted a vendetta against Michael Jackson that went on for years. He bungled the 1993 investigation with Jordan Chandler. And then in 2005 Sneddon — with no real evidence– brought Jackson to trial and destroyed him. The child molestation case was almost completely fabricated, with Sneddon at its forefront. It almost certainly led to Jackson’s death.
I watched Tom Sneddon in court through the winter and spring of 2005. He was about as unsophisticated as he could be in upscale Santa Barbara. It’s hard to believe a guy who seemed like such a hick could be popular with wealthy constituents. His pursuit of Michael Jackson was ridiculous, and you could say bordered on racist. It was clear he wanted Jackson out of Santa Ynez, Los Olivos and the whole area. Let’s not forget: Sneddon threw a victory party at a local restaurant during jury deliberations. He was convinced he’d won. It was in the poorest taste, and he was wrong, wrong, wrong.
Early on, Sneddon knew that the Arvizo family was nutty. Not only that, there was ample evidence they were lying about a lot of things starting with their “kidnapping” by Jackson. If yours truly had seen the humungous pile of receipts rung up by the Arvizo’s during their “incarceration,” certainly Sneddon knew about them, too. I certainly reported enough stories at the time detailing the Arvizos’ activities– shopping, restaurants, vacations, spa treatments– that a D.A. with a legitimate brief would have questioned the veracity of his government witnesses.
But Sneddon was out to get Michael Jackson. He’d lost out in 1993 when Jackson paid off Chandler. He wasn’t thrilled that Jackson had needled him in songs on subsequent albums. When Sneddon turned up at Neverland in November 2003 with bottom feeding tabloid reporter Diane Dimond for the big search and arrest, he showed his cards. It was a grudge match return.
That Tom Mesereau, Jackson’s defense lawyer, made such mincemeat of that prosecutors’ office should tell us everything. Sneddon did a lot of smirking in that trial. He really thought he was sending Michael Jackson to prison. He certainly humiliated the pop star. But then his case fell apart: Janet Arvizo, revealed as a welfare cheat, told Tom Mesereau she thought Jackson was going to take her kids away in a big helium balloon. She and her kids all had different stories. No one could explain how Arvizo was getting bikini waxes while Sneddon insisted she’d been taken against her will.
Jackson left Los Olivos two weeks after the trial was over. Mesereau had advised him to go. Sneddon, he said, would never give up. He’d make Jackson’s life a living hell. So I’m sorry Tom Sneddon is dead, and certainly it’s a terrible loss for his family. Maybe he was a wonderful father and husband. But his overzealousness to get even with Michael Jackson caused a lot of damage. The fact is, and people don’t like this, Michael Jackson was innocent of those charges. They should never have been brought.

Non c'è molto di buono che si possa dire su Tom Sneddon, l'ex procuratore distrettuale di Santa Barbara. E' morto all'età di 73 anni. Non si dovrebbe parlare male dei morti. Ma questo è quello che so: Sneddon ha guidato una vendetta nei confronti di Michael Jackson che è andata avanti per anni. Ha pasticciato con l'indagine del 1993 il caso su Jordan Chandler. E poi nel 2005, Sneddon, senza avere alcuna prova reale ha portato Jackson in tribunale e lo ha distrutto. Il caso relativo alla pedofilia era quasi tutto inventato, con Sneddon in prima linea. Non dimentichiamolo: Sneddon organizzò una festa in un ristorante del luogo durante le delibere della giuria. Era convinto di aver vinto. Ma non era che una sua pia illusione, e lui si era sbagliato, sbagliato, sbagliato.

Ma Sneddon, era lì per catturare Michael Jackson. Aveva perso nel 1993, quando Jackson pagò i Chandler. Non era entusiasta del fatto che Jackson lo avesse punzecchiato nelle canzoni degli album successivi. Quando Sneddon si presentò a Neverland nel Novembre 2003, insieme alla più mediocre dei giornalisti da tabloid, Diane Dimond, per la mega perquisizione e l'arresto, in quell'occasione mostrò il suo vero volto. Una sorta di sfida all'ultimo sangue..
L'avvocato difensore di Jackson, Tom Mesereau, fece carne trita di quell'ufficio del procuratore che avrebbe dovuto raccontarci tutto. Sneddon era così compiaciuto di quel processo. Pensava davvero che stava per mandare Michael Jackson in prigione.
Quello di certo che lui ha fatto è stato umiliare la Pop Star. Ma , il caso non stava in piedi e crollò; Janet Arvizo,si rivelò un'imbrogliona seriale , disse a Tom Mesereau , che era convinta Jackson avrebbe portato via i suoi figli in una mongolfiera.
Lei e i suoi figli raccontavano storie difformi. Nessuno riusciva a spiegarsi come mamma Arvizo si facesse cerette per il bikini mentre Sneddon insisteva che lei fosse stata trattenuta contro la sua volontà.
Jackson lasciò Los Olivos due settimane dopo la fine del processo. Mesereau gli aveva consigliato di andarsene. Sneddon, disse, che non si sarebbe mai arreso. Avrebbe reso la vita di Jackson un inferno. Quindi, mi spiace, Sneddon è morto, e certamente è una perdita terribile per la sua famiglia. Diane Dimond is once again capitalizing on an event surrounding Michael Jackson. She is once again using something as an excuse to shine and establish herself as his "biographer" of decades. He was her biggest story Sneddon's passing (although she may be genuinely sad) givers her another cynical opportunity to speak ill of Michael once again. It gives her ammunition to prove her assertion that "Jackson fans are crazy and delusional." She could grieve quietly but she won't because the fans reacting to her on FB or Twitter are doing exactly what she hoped they would and are playing right into her game. she can once again demonstrate to the world how "childish and "Ill-informed" Michael Jackson fans are. Fans who play along do the rest of the MJ community no favors by playing. If you stop playing into a game-- game over. She cannot be shocked or hurt- that's not how tabloid artists operate. She is smirking behind her computer and laughing about her "gotcha" tactics working. It would be better to not give her the satisfaction! We are better. We are smarter. We can give her facts, share links with her to MJ Vindicating websites, share videos that prove MJ's innocence, share statements from boys that say nothing ever happened. Do not attack Sneddon on her pages. The world has an opportunity to watch the behavior of MJ fans. Rise above! This game of hers is a never ending story and nobody is impressed by your ranting or name calling. And you will make the MJ fans once again look like bullies. Or better yet, say nothing. Silence is a way to freeze someone out, to not acknowledge them. To take away their power. Please don't engage!

While it is obvious that District Attorney Tom Sneddon has a vendetta against Michael Jackson, there are other allegations of abuse on Sneddon's part that have been ignored by the mainstream media. In November 2003, Santa Barbara defense attorney Gary Dunlap filed a $10 million lawsuit against Tom Sneddon, accusing him of racketeering, witness tampering, conspiracy and malicious prosecution. Earlier that year, Sneddon had charged Dunlap with perjury, witness intimidation, filing false documents and preparing false documents in a case that Dunlap had handled. Dunlap was acquitted on all charges but claims his reputation has been irreparably harmed as a result of the proceedings. In an interview with Online Legal Review's Ron Sweet, Dunlap claimed that Sneddon stacked the charges against him in order to get a conviction on at least one count; apparently, this is a common occurrence in Sneddon's office. Dunlap also discussed Sneddon's frequent abuse of power and claimed that there are other lawyers who have seen this. A judge recently upheld most of Dunlap's lawsuit and the case will soon go to trial unless a civil settlement is reached.
In related news, Dunlap's lawyer Joe Freeman recently sent a complaint asking that federal, state and county officials investigate Tom Sneddon and members of the Santa Barbara Police Department for misconduct. "In my opinion, the matters to be investigated are the possible criminal violations of several felony and misdemeanour statutes, including conspiracy, illegal taping, deceiving a court and a prosecutor illegally assisting the defense of a case," Freeman said in his complaint. "I respectfully request that the U.S. Attorney, the California Attorney General, the Santa Barbara County Grand Jury and the State Bar open investigations and seek whatever sanctions are found to be warranted against Sneddon and his staff." In response to the allegations, the SBPD's attorney Jake Stoddard said that Sneddon and his employees are immune from legal action because they are prosecutors.
Efren Cruz
In 2001, a man named Efren Cruz filed a federal lawsuit against Santa Barbara prosecutors accusing them of negligence and conspiracy to keep him in prison. The lawsuit also accused District Attorney Tom Sneddon of malicious prosecution. Cruz was incarcerated for four years after being convicted of murder in 1997. The lawsuit claimed that prosecutors had evidence favourable to Cruz but failed to hand it over to the defense before the trial. After Cruz was convicted, the real murderer was caught on tape confessing to the crime. Regardless, Santa Barbara prosecutors stood by their conviction until the case was taken to a higher court where Cruz was exonerated.
Thambiah Sundaram
Thambiah Sundaram's contentious relationship with Santa Barbara authorities began when he opened a non-profit dental clinic in the county and began to attain political status as a result. After unsuccessfully trying to have the clinic shut down, authorities arrested Sundaram for grand theft, impersonating a doctor and malicious mischief. His wife was also arrested and an employee at the clinic was later charged with committing a drive-by shooting. All three were found not guilty. Sundaram sued Sneddon and his employees for conspiracy, false imprisonment and several civil rights violations. He was awarded almost $300,000 in damages.
Sundaram also attended a private fundraising dinner in 1994 where Tom Sneddon and other government officials allegedly discussed their plans to get rid of certain individuals in Santa Barbara who owned substantial amounts of land. Michael Jackson's property was allegedly brought up during this meeting; Sundaram claimed that authorities wanted to acquire Neverland for vineyards.
Slick Gardner
Slick Gardner is a horse rancher who owns 2,000 acres of land in Santa Barbara. In 2003, Gardner was investigated for animal abuse after his neighbours reported that some of his horses looked unhealthy. Around the same time the allegations hit, Gardner ran for 3rd District Supervisor against John Buttny, Steve Pappas and Brooks Firestone. Firestone - who owns a successful winery in Santa Barbara and who also has political ties to Tom Sneddon and former Sheriff Jim Thomas - won the election by a landslide. As a result of the bad publicity from the animal abuse allegations, Gardner got the least amount of votes.
While investigating Gardner for animal abuse, Santa Barbara authorities also stumbled upon evidence of grand theft. Gardner was charged with 12 felony counts and hired defense attorney Steve Balash to represent him in the case. Balash later backed out of the case saying it was too complicated.
According to Gardner, Sneddon has had a grudge against him for 30 years and is only prosecuting him out of spite. "It just seems like it's almost a vendetta deal. These guys are going so far out of their way to do things to me that normally wouldn't be done," Gardner said.
"The same thing that’s happening to Michael Jackson happened to me. One day Sneddon is going to wake up with a boot up his ass with a white glove in it, and it will be about time."
Judge Rodney Melville, the same judge who will be presiding over Michael Jackson's trial, is also involved in Gardner's case.
Adams Bros. Farming, Inc.
In 1997, the Adams brothers purchased 268-acres of land in Orcutt and began agricultural grading on the site. 95-acres of their land was deemed an "environmentally sensitive wetland" by Santa Barbara authorities, which prevented the farmers from using it.
The brothers filed a lawsuit against the County in 2000, alleging that officials had falsely designated a portion of their land as wetland in an attempt to jeopardize the company's financial earnings. At the request of Santa Barbara County officials, Judge Rodney Melville dismissed the brothers' action. The brothers took their case to an appeals court where Melville's decision was overturned.
The Court of Appeals ruled that the County had violated the company's constitutional right to use its land and that the County and a county consultant had conspired to interfere with the company's income.
Emilio Sutti
Emilio Sutti is a dairyman and farmer who recently filed a $10 million lawsuit against Santa Barbara County, claiming to have been the target of a government conspiracy to interfere with his company's profits. Sutti alleged that Santa Barbara authorities have been targeting his family's land for years. The battle began when Emilio's brother and business partner Ed was sued by Santa Barbara County Planning and Development for alleged environmental and grading ordinance violations.
After winning a partial victory in the lawsuit, Ed Sutti was arrested and indicted for arson, witness intimidation, making terrorist threats, making false statements to an insurer, giving false deposition and four counts of state income tax evasion.
Emilio's Sutti's civil lawsuit was handled by Judge Rodney Melville.
Nuevo Energy Company
According to an article from The Lompoc Record: “Nuevo Energy Company has a launched a three-pronged legal attack on Santa Barbara County, claiming it violated state environmental law in using wrong baseline data in an environmental impact report, wasn't the correct lead agency to prepare the report and wrongly applied mitigation measures in denying the Tranquillon Ridge project.” Judge Rodney Melville presided over the case.
Art Montandon
Santa Maria City Attorney Art Montandon recently filed a claim against the Santa Barbara County District Attorney's Office, alleging that they falsely accused him of bribing a defense attorney in a case that Sneddon was prosecuting. Montandon had evidence favourable to the defense and prosecutors tried to stop him from interfering by threatening to bring bribery charges against him. A judge later ruled that Sneddon's office had no right to stop Montandon's involvement in the case.
In a letter, Montandon denied any wrongdoing and lashed out at Sneddon and his employees, saying: "Unlike (Assistant District Attorney Christie) Stanley and current and former members of her office, I have never had my license to practice law suspended by the State Bar, have never been convicted of a crime, and have never been terminated from any attorney job."
At the end of his letter, Montandon said he would reveal in court: "the full and complete story of not only the District Attorney's unprofessional conduct, but the inappropriate conduct and motives of others working behind the scenes to cause community conflict."
Recently, Montandon requested that the State Bar investigate Sneddon and his office for obstruction of justice.
William Wagener
William Wagener ran for 5th District County Supervisor in 2002 and was arrested shortly before the election. Because he was a convicted felon, Wisconsin authorities claimed that he had no right to run for political office. As a result, Wagener was arrested by Santa Barbara authorities.
In response, Wagener's attorney John Holland said that his client’s prior conviction should have had no effect on his right to be a political candidate. He also said that because the terms of Wagener's probation had been given to the SBPD in 1998, authorities were already aware of his record when they allowed him to run for office.
The charges against Wagener were dropped and he was released from jail. Still, his attorney accused Sneddon's office of making sure Wagener was: "defamed and ridiculed in the local media in order to destroy his campaign for public office." Wagener filed a lawsuit against the city of Santa Maria, Santa Barbara County and former Police Chief John Sterling, accusing them of violating his civil rights.
The lawsuit alleges that Police Chief John Sterling "had actual, advance knowledge of the plan by other defendants to falsely arrest, inaccurate and violate (Wagener's) California and Federal civil rights." Wagener claimed that authorities conspired against him because they wanted his opponent Joe Centeno to win the election.
Diana Hall
According to Gary Dunlap, when a local judge refused to change her ruling in Sneddon's favour, Sneddon brought bogus charges against her, ruined her career and publicly humiliated her by exposing that she was a lesbian. When it became apparent to Sneddon that this judge would be a witness in the Gary Dunlap case, he threatened to bring more charges against her. The judge in question is Diana Hall.
On September 29, 2003, Hall was acquitted on charges of battery but eight months later found herself accused of violating campaign laws. On January 16th, 2004, she showed up at Michael Jackson's arraignment because she wanted to see how Judge Rodney S. Melville handled motions. Hall told reporters: "I'm not being treated well. This has ruined my reputation, and I'm just not going to take it any longer."

In 2002, Santa Barbara County law enforcement groups filed a lawsuit against Tom Sneddon for threatening the police officers' right to privacy. The lawsuit stems from a policy which allows the District Attorney's office to give information about police misconduct to defense attorneys at its own discretion. According to Sgt. Mike McGrew, "It's confusing. He's an aggressive DA. There are actually no files right now on any officers in Santa Barbara. We really don't know why he did this." Future blackmail material perhaps?
David Allen Richardson, Carina Richardson and George Beeghly
In a civil lawsuit that was settled out of court, David Allen Richardson, Carina Richardson George Beeghly sued Sheriff Jim Thomas and several Santa Barbara police officers for unreasonable search and seizure, false arrest/false imprisonment, excessive force, retaliation for exercise of speech and petition rights, conspiracy to violate civil rights, violation of First Amendment right of association, malicious prosecution, negligence, battery and conspiracy and other charges.
The Case Sneddon Ignored
Is Tom Sneddon a concerned government official seeking justice for an allegedly abused child or is he merely a prosecutor with a grudge trying to get a conviction? Sneddon’s handling of a past child molestation case would indicate the latter.
In 2002, David Bruce Danielson, a forensic investigator for the Santa Barbara Police Department, was accused of molesting a 14-year-old girl. After returning home intoxicated, Danielson climbed into his bed where the girl, who was a guest at his home, was sleeping. Danielson admitted to “accidentally” molesting her, claiming he had mistaken her for his wife. Sneddon closed the case stating that there was no evidence to corroborate the girl’s claims.
The girl involved in the case wrote her feelings down in a letter that was published in the Santa Maria Times. “I am astounded at the stupidity the DA showed by allowing this man to be released of all charges. David Danielson may be free, but I am still emotionally trapped. There is not one day that I don't wish I wouldn't have come clean.”
About Sneddon’s handling of the Michael Jackson case, the girl’s father said, “Maybe it’s because it is high profile… but still, in her mind it’s the same situation. She’s still angry.”
While it seems that child abuse might not be Tom Sneddon’s first priority, the question still remains whether or not he would really pursue seemingly false allegations in order to carry out his own personal agenda. After learning the facts about the Michael Jackson case and reading through the numerous accusations that have been made against Tom Sneddon, I'll let you draw your own conclusions about that...
Druyan Byrne
In September 2003, a drama teacher named Druyan Byrne was arrested after police were told that Byrne had photographs of a partially nude 15-year-old girl on his camera. Although the photographs were taken for an art project and were not sexual in nature, authorities insisted on going forward with their case against Byrne.
The girl in the photographs, who was brought in for questioning on five separate occasions, repeatedly denied that anything sexual had transpired between her and Byrne. In response, police told the girl that she was a liar and that it was "obvious to everyone around here that there is some kind of relationship going on."
Santa Barbara Police Detective Stuart Gardner then lied to the girl, falsely stating that police had proof of Byrne's past sexual relationships with minors. Although no such evidence actually existed, Gardner convinced the girl that Byrne was a sexual predator and that it was up to her to prevent him from harming anybody else. "I’m just telling you the pattern with these guys. And he fits it to a tee," Gardner told the girl. "Do you see how this could happen to other girls? Do you see how important you are that this isn’t going to happen to any other girls?"
After being interrogated for hours, the girl finally told Gardner that she and Byrne had kissed on the lips, a statement that she later recanted. "I felt the only way I was going to get out of that room was to tell [Gardner] what he wanted and tell him something happened," she testified.

Conrad Jess Zapien
In 1985, Conrad Jess Zapien was arrested for allegedly murdering his brother-in-law's mistress. While jury selection was underway, Deputy District Attorney Gary Van Camp and investigator Harry Heidt inadvertently came across a tape that belonged to Zapien's defense counsel. The tape was in a sealed envelope that bore the name of Zapien's attorney Bill Davis.
Upon finding the package, Van Camp allegedly urged Heidt to open the envelope and listen to the tape. Van Camp later denied ever having made such a statement and both he and Heidt denied ever having listened to the tape, an act that would have violated Zapien's attorney-client privileges. Rather than return the package to Zapien's attorney, Heidt discarded of the package by throwing it in a dumpster.
Zapien's attorney argued that by getting rid of the package, Heidt had "deprived the defense of the only physical evidence it could use to impeach Heidt and Van Camp regarding whether they unsealed the envelope and listened to the tape." For example, if the envelope was unsealed, he argued, such evidence would have contradicted both Van Camp's and Heidt's assertion that they did not open the package. Furthermore, tests could have been conducted on the tape to determine whether or not it had been listened to.
Zapien later filed a motion asking that Tom Sneddon and the entire Santa Barbara County District Attorney's office be recused from the case. Zapien argued that although Sneddon had taken Van Camp off of the case, he failed to properly investigate the violation of Zapien's attorney-client privileges. He further argued that Sneddon brought an auto theft charge against him even though there was no credible evidence to support the charge. Zapien's motion was denied.
Anthenasios Boulas
In 1985, a man named Anthenasios Boulas retained a lawyer after being arrested for selling cocaine. Shortly after hiring the lawyer, referred to in court documents as "Attorney S," Boulas also hired a Private Investigator named William Harkness. On Boulas’ behalf, Harkness got in contact with sheriff’s deputy Scott Tunnicliffe to inquire about a possible plea bargain. In exchange for leniency, Boulas would provide authorities with the names of several drug dealers in the area. “Attorney S” was not aware of this potential deal.
After meeting with Boulas and Harkness, Tunnicliffe broached the subject of a plea bargain to Robert Calvert, the Deputy District Attorney at the time. Calvert said that he would only agree to the deal if Boulas fired his attorney and hired a lawyer that met with his approval. After being convinced by Tunnicliffe that “Attorney S” was a drug addict who could not be trusted, Boulas fired him and attempted to find another attorney. Taking the advice of Sheriff’s deputies, he hired “Attorney C,” who later backed out of the case.
Without a lawyer representing him and under the pretense that he would be receiving a plea bargain, Boulas met with authorities and gave them information about several drug dealers in the area. After giving them this information, Boulas was told by authorities that the plea bargain would no longer be possible.
Several months later, Boulas filed a motion to have the charges dismissed. The court ruled that although “conduct by the district attorney's office and the sheriff's department interfered with his rights to counsel and to a fair trial,” they would not drop the charges against him.
Boulas then took his case to a higher court where the case was ultimately dismissed. According to documents, the court found the conduct of Sneddon's office: “outrageous in the extreme, and shocking to the conscience; we are, thereby, compelled to order the dismissal of the present case.”
James William Herring
In 1993, the Santa Barbara District's Attorney's office was admonished for making racially insensitive comments during the trial of James William Herring, a biracial man who had been accused of rape. During closing arguments, prosecutors described Herring as "primal man in his most basic level... his idea of being loved is sex. He wouldn't know what love was. He's like a dog in heat."
Herring's conviction was overturned because of the highly prejudicial, unfounded comments that prosecutors made about him throughout the trial. Prosecutors described him as a “parasite” and made the inference that because Herring was unemployed, he was more likely to have raped the complaining witness. Furthermore, prosecutors made inflammatory comments about defense attorneys in general, saying: “my people are victims. His people are rapists, murderers, robbers, child molesters. He has to tell them what to say. He has to help them plan a defense. He does not want you to hear the truth.” Such a statement created the false impression that anyone who is accused of a crime is guilty.
The Court of Appeals ruled that "the prosecutor's... statements about a biracial defendant are, at the very least, in bad taste" and that his unfounded remarks about Herring’s defense counsel lead to an unfair conviction. As a result, Herring's conviction was overturned.
Richard Joal Wagner
In the early 1970s, Richard Joal Wagner was convicted in a Santa Barbara court of selling marijuana. He appealed the jury’s conviction, claiming prosecutorial misconduct during his own cross-examination because prosecutors implied that he had been caught dealing narcotics in the past. Some of the questions asked include:
"Q. Isn't it true, Mr. Wagner, that in Alaska you are not only in the business of putting up fences, but you are also in the business ... of furnishing cocaine a drug, for sale, illegally, isn't that correct?
"Q. ... Isn't it true that you have in fact sold heroin?
"Q. ... To your knowledge, at your place of business, is there any illegal sale of narcotic activity going on?
"Q. ... Isn't it true that on December 30, 1971, that you have received ... a shipment of 'pure pharmacy' cocaine?
"Q. ... Now, isn't it true that on December 30, 1971, you had in your possession approximately three kilograms of pure pharmacy cocaine . .?
"Q. ... Isn't it true that those three kilograms of cocaine were in a shoebox?"
Although prosecutors failed to present any evidence of Wagner’s alleged past offenses, they created the impression in the minds of the jurors that Wagner had been involved in the sale of narcotics before, thus leading to an unfair conviction. Sneddon was not the District Attorney at the time but he was one of the led prosecutors on the case. The appeals court ruled that the conduct of the District Attorney's office was prejudicial to the defendant and thus overturned Wagner's conviction.

Il legale Dunlap nel Novembre 2003 ha depositato una querela con richiesta di 10 milioni di dollari contro Tom Sneddon accusandolo di racket , testimonianze manipolate , cospirazione , azioni penali dolose.
Sneddon aveva accusato Dunlap di intimidazione dei testimoni , archiviazione e diffusione di documenti falsi in un caso del quale Dunlap si era occupato.
Dunlap è stato assolto da ogni accusa , ma sosteneva che comunque la sua reputazione era stata irrimediabilmente rovinata a seguito di quel procedimento.
Dunlap le metodiche e l'abuso di potere da parte di Sneddon , sostenendo che anche altri legali potevano testimoniarlo. Il giudice accetto la querela di Dunlap , e il caso finì in giudizio.
Efren Cruz
Nel 2001 ha intentato una causa federale contro i Procuratori di S.Barbara , accusandoli di negligenza e cospirazione per averlo tenuto in carcere per 4 anni pur essendo innocente (il vero assassino è stato catturato in seguito).
L'azione federale è stata intentata anche contro il Procuratore Tom Sneddon per danno doloso.
Thambiah Sundaram
Il contezioso tra Sundaram e le autorità di S.Barbara è iniziato quando Sundaram ha aperto una clinica odontoiatrica no-profit , raggiungendo in seguito un determinato status politico.
Dopo aver cercato invano di far chiudere la clinica, le autorità di S.Barbara hanno arrestato Sundaram per furto , per aver impersonificato un medico e per aver compiuto atti di malvagità. Anche sua moglie e un dipendente furono arrestati per una sparatoria in auto.
Tutti è tre sono risultati NON colpevoli . Sundaram ha citato Sneddon ed i suoi collaboratori per cospirazione, imprigionamento senza prove e diverse violazioni dei diritti civili. Ottenne un rimborso di 300.000 dollari per risarcimento danni.
Sundaram ha anche partecipato ad una cena di raccolta fondi privati nel 1994, dove Tom Sneddon e altri funzionari del governo , discutevano liberamente i loro piani per sbarazzarsi di alcuni individui a Santa Barbara che possedevano notevoli quantità di terra. E nel corso di questo incontro , anche le proprietà di Michael Jackson furono discusse ; Sundaram ha affermato che le autorità volevano acquistare Neverland per farne dei vigneti.
Slick Gardner
Slick Gardner è un allevatore di cavalli che possiede 2.000 ettari di terreno a Santa Barbara. Nel 2003, Gardner è stato indagato per maltrattamento di animali dopo che isuoi vicini avevano riferito che alcuni dei suoi cavalli sembravano versare in condizione malsane.

Adams Bros. Farming, Inc.
Nel 1997 i fratelli Adams hanno acquistato 268 acri di terra in Orcutt . 95 ettari della loro terra è stata considerata una "zona umida ambientalmente sensibile" da parte delle autorità di Santa Barbara, cosa che ha così impedito agli agricoltori di poterla utilizzare.
I fratelli intentano una causa contro la contea nel 2000, sostenendo che i funzionari avevano falsamente designato una porzione della loro terra come zona umida, nel tentativo di mettere a rischio i guadagni finanziari della società. Su richiesta dei funzionari della contea di Santa Barbara, il giudice Rodney Melville respinse il ricorso dei fratelli '. I fratelli portarono il caso in corte d'appello , che annullò la decisione di Melville.
La Corte d'Appello stabilì che la contea aveva violato il diritto costituzionale della società di usare la sua terra e che la Contea e un consulente della contea avevano cospirato per interferire con il reddito della società.
Emilio Sutti

Art Montandon
Il procuratore Art Montandon della contea di Santa Maria ha recentemente presentato un reclamo contro l'Ufficio Distrettuale del Procuratore di Santa Barbara , relativo al fatto di essere stato accusato senza prove di aver corrotto un avvocato difensore in un caso nel quale Sneddon era impegnato. In una lettera, Montandon negò ogni accusa e si è scagliò contro Sneddon ed i suoi dipendenti, dicendo: "A differenza di Stanley(l'assistente del procuratore distrettuale Christie Stanley) e i membri ed ex-membri del suo ufficio, non ho mai avuto una sospensione della mia licenza all'esercizio della professione forense da parte dello State Bar, non sono mai stato condannato per un reato, e non sono mai stato precluso da qualsiasi lavoro come avvocato ".
Alla fine della sua lettera, Montandon ha detto che avrebbe rivelato in tribunale: "la storia completa, non solo del comportamento poco professionale del procuratore distrettuale, ma del comportamento inadeguato e le motivazioni degli altri che lavorano dietro le quinte per creare conflitti nella comunità".
Recentemente, Montandon ha chiesto che lo State Bar indaghi su Sneddon e il suo ufficio per intralcio alla giustizia.
William Wagener
Nel 2002 era candidato alle elezioni come Supervisore del 5° Distretto. Venne errestato prima delle elezioni perchè , secondo le autorità del Wisconsin era un criminale , e pertanto non aveva il diritto di partecipare allle elezioni. Di conseguenza Wagener venne arrestato dalle autorità di S. Barbara.
Secondo la documentazione presentata dal legale di Wagener le autorità erano a conoscenza della situazione di Wagener dal 1998 , quindi anche quando gli hanno dato il permesso di candidarsi alle elezioni.
Le accuse contro Wagener sono cadute ed è stato scarcerato. Il legale di Wagener dichiarò, che lo scopo dell'arresto e accuse era stato solo quello di diffamarlo e ridicolarizzarlo attraverso i media locali al fine di distruggere la campagna politica per una carica pubblica. Wagener ha intentato una causa contro la città di Santa Maria, contea di Santa Barbara e l'ex capo della polizia John Sterling, accusandoli di aver violato i suoi diritti civili.
Nell'azione legale si sostiene che il capo della polizia John Sterling era a conoscenza del piano con gli altri imputati, Wagener ha affermato che le autorità hanno cospirato contro di lui perché volevano che il suo avversario Joe Centenoper vincesse le elezioni.

Diana Hall
Quando il giudice locale Diana Hall si rifiutò di modificare la sua decisione in una sentenza , Sneddon ha cominciato a muovere accuse contro di lei , le ha rovinato la carriera umiliandola pubblicamente e mettendo in giro voci che era lesbica.
Nel settembre 2003 è stata assolta da una serie di accuse , e il 16 Gennaio 2004 si è presentata al processo di Michael Jackson per vedere come il giudice Rodney S. Melville l'avrebbe gestito. Hall ha detto ai giornalisti: " Io non sono stata trattata bene , hanno rovinato la mia reputazione".

Druyan Byrne
Nel settembre 2003, un insegnante di teatro di nome Druyan Byrne venne arrestato, dopo che alla polizia venne detto che Byrne aveva foto di nudo parziale di una ragazzina di 15 anni. Anche se le foto erano state scattate per un progetto artistico e non erano di natura sessuale, le autorità insitettero per proseguire le loro accuse contro Byrne. La ragazza nella foto, sottoposta ad interrogatorio in ben 5 occasioni, negò con veemenza e più volte sul fatto che ci fosse stato un qualche intento sessuale in Byrne. Conrad Jess Zapien

Nonostante i pubblici ministeri , non avessero presentato alcuna prova di presunti reati nel passato di Wagner, hanno creato l'impressione nella mente dei giurati il presupposto che Wagner era stato coinvolto in vendita di sostanze stupefacenti prima di quel processo, portando così a una convinzione erronea. Charles Thomson - On Tom Sneddon
The death of former Santa Barbara District Attorney Tom Sneddon sparked jubilation among the Michael Jackson fan community. The DA who twice failed to convict the star on child abuse charges died on Saturday, November 1, with his family at his side, from complications following a cancer diagnosis.
It was Tom Sneddon who pursued Jackson in 1993 over the Chandler family’s sexual abuse accusations – a case which fell apart when the accusers solicited a pay-out from an insurance company and stopped cooperating with the authorities. Then, it was Sneddon who charged and personally prosecuted Jackson a decade later when Gavin Arvizo, who famously appeared alongside the singer in a Martin Bashir documentary, made similar accusations.
For many Jackson fans, Sneddon was evil personified; a larger-than-life boogieman who masterminded a conspiracy to destroy their idol’s career. Undeniably, his professional conduct was extremely poor in the Jackson trial. But just as images of Jackson’s bereft children after his death reminded us that despite his superstardom, he was a man with a family like anybody else, so too the thought of Tom Sneddon surrounded by loved ones on his deathbed should remind us of the same. Fans' remarks about the prosecutor ‘rotting in hell’ will not affect Tom Sneddon. He’s not here to read them. It is his loved ones who are left behind to cope with them – and there is no reason why they should have to. Such comments are tasteless in the extreme and do not reflect well on Jackson’s followers.
Of course, those followers would likely argue that it was Sneddon who made things personal. They would have a point, too. Sneddon seemed to relish persecuting the musician. In a series of gleeful media appearances in November 2003, to reveal the Arvizo accusations, he cracked jokes, mocked Jackson’s art and referred to him as ‘Jacko Wacko’ – behaviour for which he was later forced to apologise.
But there was more to it than that. Sneddon didn’t just seem to enjoy prosecuting Jackson; he appeared obsessed by it – so much so that he repeatedly acted beyond his brief in his zeal to bring down the star. He removed clearly-labelled, privileged defence documents from the home of Jackson’s personal assistant. He made ‘factual’ assertions in front of grand jurors when he shouldn’t have done. He tampered with his case to circumvent exculpatory evidence. He even seemingly tried to plant fingerprint evidence. He over-stepped the mark, time and again.
Jackson’s fans largely believe Sneddon knew Jackson was innocent all along; that he had a personal grudge against Jackson and fabricated the cases against him. I’ve never been totally convinced of his supposed motives. The fans' theory tends to be that Sneddon was desperate for prestige; that the prospect of convicting the world’s most famous musician became an egomaniacal obsession.
Admittedly, there is some evidence which supports that theory. In November 2003, Sneddon raided Jackson’s Neverland Ranch with a reported 70 sheriffs and multiple helicopters. What use is a helicopter when searching for evidence of child molestation? It was an obvious stunt. Reporters were on the scene before police even arrived. The entire operation was designed to generate attention. Sneddon’s behaviour in front of TV cameras at the time suggested he enjoyed the press attention, too; he seemed intoxicated by it. But was he basking in the limelight, or just displaying very poor judgement, as he later claimed?
What's certain is that poor judgement became a feature of the prosecution. The decision to proceed to trial was in itself highly questionable. In one of many troubling incidents, Sneddon and his team learned after Jackson was arraigned in January 2004 that he had an alibi for all the dates on the charge sheet. Realising the family’s current story could not be true, Sneddon - rather than reconsidering the validity of the prosecution - simply changed the dates on all the charges, even though it threw out the whole timeline. His case no longer made any sense, but he bullishly pursued it anyway.
The holes were gaping and plentiful. The accuser initially claimed he’d been molested up to six times, but later said it was ‘one or two’. He originally said Jackson instigated the molestation by telling him boys had to masturbate, or else they’d become rapists. He later conceded it was actually his grandmother who told him that.
The boy’s brother, who claimed to have witnessed the molestation, gave contradictory accounts. Originally, he claimed Jackson and the boy had laid on their sides as Jackson rubbed his penis on the boy’s buttocks. Later, he said they’d been side-by-side as Jackson fondled the boy’s genitals. By the time their mother took the stand and made a number of increasingly wild assertions about hot air balloon kidnap plots, Sneddon was reportedly seen with his head in his hands.
As the trial progressed, it is therefore unsurprising that Sneddon appeared to become less enamoured with the spotlight. The obvious assumption was that this was connected to his crumbling case, but others felt accusations of glory-hunting were untrue from the off. Rather, they contended aggressive prosecutions were simply his modus operandi – hence his nickname: ‘Mad Dog’.
In a November 2003 profile by Associated Press, acquaintances said Sneddon was always relentless in his pursuit of justice. The piece said he was ‘tenacious and tough, particularly when he has made up his mind about a case – sometimes to a fault’. Superior Court Judge James Slater supported that allegation, commenting, “There were times, and there still are, where his tenaciousness gets in the way of his better judgement and he has to step back.”
Jerry Roberts, editor of the Santa Barbara News Press, told CBS: “He’s a law-and-order guy who sees the world in black and white. There’s bad guys and good guys, and he sees himself as the good guy.”
But Jackson was not a ‘bad guy’, according to the jurors who heard all Sneddon’s evidence and then acquitted the him unanimously on all charges. And therein lies the problem with prosecutors like Tom Sneddon.
Cop shows are obsessed with authority figures who don’t play by the rules. Due process is routinely depicted as an irritant; a bureaucratic box-ticking exercise. As viewers, we are manipulated into rooting for cops who play dirty to nail people they ‘know’ are guilty. We come to despair of laws which prevent the Government locking people up on the ‘technicality’ there there’s no evidence against them.
To achieve this blind trust of authority figures, the shows tend to portray the ‘baddies’ as cartoonish master-villians, sneering at the prosecutors and mocking their professional impotence. The writers place us in the shoes of the victim or their relatives, making it all too easy to fall into the trap of sympathising with the corrupt officials. We are less often encouraged to sympathise with the accused – ‘How would I feel if it was me, or my brother, that they were planting evidence against, or entrapping?’
Due process exists to protect the innocent, not the guilty. If we allow investigators to break the rules for a supposedly ‘good cause’, we set a precedent which will inevitably make it easier to lock up the innocent. Actions like Sneddon's - like stealing defence information, and tailoring a prosecution to circumvent objective evidence undermining the charges - compromise the integrity of the entire system.
After his death, current Santa Barbara DA Joyce Dudley called Sneddon ‘a pioneer in many areas of prosecution, especially crimes against vulnerable victims’. She added that he founded Santa Barbara’s Sexual Assault Response Team.
I don’t doubt that’s true. Unquestionably, in his more than 20 years as DA, Sneddon will have secured justice for many victims. It is unfortunate, therefore, that he persisted in his quest to convict Jackson. A case of that magnitude was destined to define his career – and it will stand forevermore as a monument to the very worst aspects of his professional conduct.
Less than 10 years after the trial concluded, both men are dead. In the eyes of many Jackson fans, Sneddon contributed significantly to Jackson’s demise. So traumatised he could not rest without the assistance of hospital grade anaesthetic, the singer was accidentally killed by his doctor in 2009. Now Sneddon is gone too. May they both rest in peace – but may Sneddon’s catalogue of misconduct be a lesson to all, in how not to spend taxpayers’ money.

Le osservazioni di alcuni fan sul procuratore come ' che possa marcire all'inferno 'non influenzeranno Tom Sneddon. Lui non è qui per leggerli. Ma ci sono i suoi cari che dovranno far fronte a questo - e non c'è alcuna ragione per cui debbano farlo. Tali commenti sono di cattivo gusto nella maniera più estrema e non riflettono il bene che i fan volevano a Jackson.
Naturalmente, questi fan si sentono giustificati dal fatto che Sneddon ha agito per questioni sue personali. E così il cerchio è chiuso. Sneddon sembrava davvero godere nel perseguitare il musicista. In una serie di apparizioni sui media , nel novembre 2003, per parlare delle accuse degli Arvizo, ha espresso diverse frasi di scherno, ha preso in giro l'arte di Jackson e si riferiva a lui come 'Jacko Wacko' - comportamenti per i quali è stato poi costretto a chiedere scusa.
Ma c'era di più oltre a questo. Ha nascosto reperti etichettati, documenti che erano importanti per la difesa di Jackson. Ha fatto affermazioni "di fatto" di fronte al Gran Giurì, quando non avrebbe dovuto farlo. Ha infangato e pilotato il caso per aggirare le prove a discolpa. Ha anche apparentemente tentato di far apparire dal nulla delle impronte digitali. Ha oltrepassato il segno, molte volte.
I fan di Jackson in gran parte credono che Sneddon sapesse che Jackson era innocente; ma aveva un rancore personale contro Jackson e così ha costruito i casi. Non sono mai stato del tutto convinto delle sue presunte motivazioni. La teoria dei fan tende a dimostrare che Sneddon era alla disperata ricerca di un prestigio personale; che la prospettiva di condannare il musicista più famoso del mondo fosse l'espressione del suo ego maniacale.
Certo, ci sono alcune evidenze che sostengono questa teoria. Nel novembre 2003, Sneddon fece irruzione nel Neverland Ranch di Jackson insieme ad un plotone di 70 sceriffi , oltre agli elicotteri. A che serve un elicottero nella ricerca di prove di molestie su minori?
Fu un evidente bravata. I giornalisti erano sulla scena ancor prima che la polizia arrivasse. L'intera operazione è stata progettata per catturare l'attenzione della pubblica opinione. Il comportamento di Sneddon davanti alle telecamere, in quel momento fa capire chiaramente quanto godesse dall'essere all'attenzione dei Media ; sembrava esserne intossicato. Ma è stato per crogiolarsi quindi davanti ai riflettori, o molto più semplicemente per aver avuto una scarsa capacità di giudizio, come dichiarò in seguito?(n.d.r .. io non ho memoria di questo mea culpa.. potrei anche sbagliarmi, ma ricordo soltanto le sue parole dopo il verdetto, e non mi sembravano affato un mea culpa).
Quello che è certo è che la scarsa capacità di giudizio è diventata una caratteristica della Procura. La decisione di procedere in giudizio era di per sé molto discutibile. In uno dei tanti episodi avvenuti e oserei dire inquietanti, Sneddon e il suo team capirono che quando Jackson era stato chiamato in giudizio nel gennaio del 2004, aveva alibi per tutte le date indicate nei documenti di accusa.
Se non lo aveva già capito o lo sapeva, di certo realizzò in quel momento che la storia della famiglia Arvizo era falsa, ma Sneddon - piuttosto che riconsiderare la validità o l'etica della Procura coinvolta- decise più semplicemente di cambiare le date di tutte le dichiarazioni, persino e senza preoccuparsi delle incongruenze che questo avrebbe comportato. Il suo caso già non aveva più senso, eppure lui, come un bullo è andato avanti lo stesso.
C'erano buchi ovunque nelle dichiarazioni. L'accusatore aveva inizialmente sostenuto che era stato molestato fino a sei volte, ma poi ha detto che al massimo erano state 'una o due'. Ha inizialmente ha detto che Jackson istigava le molestie dicendo ai ragazzi di masturbarsi fra loro , altrimenti sarebbero diventati degli stupratori. In seguito ha ammesso che quella frase era invece stata di sua nonna..
Il fratello del ragazzo, che ha affermato di aver assistito alla molestia, non ha fatto altro che dichiarazioni contraddittorie. Prima aveva sostenuto, che Jackson, si strofinava contro il ragazzo ( Gavin) stando dietro di lui. Più tardi, che erano uno a fianco a l'altro mentre Jackson gli accarezzava i genitali. Quando la madre salì sul banco dei testimoni fece una serie infinita di affermazioni sempre più assurde, dalla paura di trame per rapimenti scappando in una mongolfiera e oltre , mi è stato detto che Sneddon , si teneva la testa fra le mani.
Man mano che il processo andava avanti, è quindi sorprendente notare che Sneddon sembrava molto meno innamorato del fatto di essere sotto i riflettori. L'ipotesi più ovvia era che questo cambiamento, fosse correlato alla fatiscenza del suo caso, mentre altri pensano che lui sapesse sin dall'inizio di dare la caccia ad un innocente. C'è anche da sapere, in caso, che il suo sistema aggressivo era il suo modus operandi - e per il quale ha poi ricevuto il soprannome di: 'Mad Dog'.
In un articolo del 2003 della Associated Press, alcuni conoscenti sostengono che Sneddon era implacabile nella ricerca della giustizia. Un uomo 'tenace e rigido, soprattutto quando aveva deciso su un caso' - a volte prendendo anche rimproveri dalla corte. Il Giudice della Corte Suprema, James Slater, sostenne in proposito questo: "Ci sono stati momenti, e ci sono ancora, dove la sua tenacia sembra mettersi di mezzo nel rispetto di un giudizio obbiettivo e deve fare un passo indietro."
Jerry Roberts, direttore del News Press di St.Barbara, ha detto alla CBS: "E 'un uomo dedito alla legge e l'ordine che vede il mondo in bianco e nero. Ci sono i cattivi e i buoni, e lui vede se stesso come una brava persona".
Ma Jackson non era un 'cattivo', secondo i giurati che hanno ascoltato tutte le prove raccolte da Sneddon e poi lo hanno assolto ad unanimità. E qui sta il problema con i procuratori come Tom Sneddon.
Le esternazioni dei poliziotti, dicono che sono ossessionati con le figure rappresentanti l'autorità, che non rispettano le regole. Un processo è raffigurato come un " ordinariamente irritante"; un esercizio di ticchettio burocratico. Come spettatori, siamo manipolati radicalmente in favore dei poliziotti che giocano sporco per inchiodare persone che 'sappiamo' essere colpevoli. Ci disperiamo nell'assistere all'esistenza di leggi che impediscono al governo di rinchiudere il delinquente per un 'tecnicismo' e tale da far cadere la accuse contro di lui.
Ma per ottenere questa fiducia o certezza del risultato contro le figure autorevoli, queste esternazioni, tendono a ritrarli come i cattivi come" cattivi esempi, o cartoni animati , facendosi beffa dei pubblici ministeri e beffandosi della loro impotenza professionale. Gli scrittori si dispongono nei panni della vittima o dei suoi parenti, il che rende sin troppo facile cadere nella trappola del simpatizzare per i funzionari corrotti. Siamo molto meno spesso incoraggiati a simpatizzare con l'imputato - 'Come mi sentirei se fosse mio fratello, la persona contro la quale stanno inventando prove pur di incarcerarlo?'
L'esistenza di un giusto processo è per proteggere gli innocenti, non i colpevoli. Se permettiamo agli investigatori di rompere le regole per una presunta 'buona causa', abbiamo solo creato un precedente che inevitabilmente renderà più facile catturare solo gli innocenti. Azioni come quelle di Sneddon - come anche occultare le informazioni alla difesa, e adattando un procedimento penale per aggirare l'evidenza oggettiva che minava le accuse - compromette l'integrità dell'intero sistema.
Dopo la sua morte, a Santa Barbara il vice DA, Joyce Dudley, ha definito Sneddon 'un pioniere in molte aree dell' azione penale, in particolare i crimini contro le vittime vulnerabili'. Ha aggiunto che ha fondato il Sexual Assault Response Team(Squadra di risposta contro la violenza sessuale).
Non dubito che sia vero. Senza dubbio, nei suoi oltre 20 anni come Procuratore, Sneddon avrà assicurato alla giustizia molte vittime. E 'un peccato, quindi, che persistesse nel suo tentativo di condannare Jackson. Un caso di tale portata era destinato a marchiare la sua carriera - e questo resterà per sempre come il simbolo degli aspetti peggiori della sua condotta professionale.

Saturday, October 27 died Tom Sneddon, the ex district attorney known for prosecuting pop star Michael Jackson, on two occasions, in 1993 and 2005.

We report here some disturbing aspects (to say the least) of his career as a prosecutor.
Sundaram case
On April 30, 2004, on the same day that the indictment against Jackson was unsealed, there was another and far less public event unfolding, one that may have a future impact on the Jackson case. Serious allegations of a pattern of abuses among Santa Barbara law enforcement and the DA’s office, including District Attorney Tom Sneddon, were made by Santa Barbara County dentist, Thambiah Sundaram. The contentious relationship with Santa Barbara authorities began when he opened a non-profit dental clinic in the county and began to attain political status as a result . After unsuccessfully trying to have the clinic shut down, authorities arrested Sundaram for grand theft, impersonating a doctor and malicious mischief. His wife was also arrested and an employee at the clinic was later charged with committing a drive-by shooting. All three were found not guilty. Sundaram sued Sneddon and his employees for conspiracy, false imprisonment and several civil rights violations. He was awarded almost $300,000 in damages. undaram also attended a private fundraising dinner in 1994 where Tom Sneddon and other government officials allegedly discussed their plans to get rid of certain individuals in Santa Barbara who owned substantial amounts of land. Michael Jackson’s property was allegedly brought up during this meeting; Sundaram claimed that authorities wanted to acquire Neverland for vineyards.
Racist remarks were allegedly made on that occasion. According to Sundaram, other alleged vendettas were discussed as well, to the extent where he said it resembled a Mafia planning session.
Dunlap case
Sundarm’s allegation are not an isolated instance. There have beeen many complaints and law-swuit against the Santa Barbara DA’s office. The new counts against Jackson may be consistent with a pattern that Santa Barabara defence attorney Gary Dunlap called “stacking charges”. In an interview on MJJF Talk Radio, on January 2, 2004, Dunlap gave his opinion that “stacking charges” was a common practice of the DA’s office, and claimed that this was a tactic used against him.
In November 2003, Santa Barbara defense attorney Gary Dunlap filed a $10 million lawsuit against Tom Sneddon, accusing him of racketeering, witness tampering, conspiracy and malicious prosecution. Earlier that year, Sneddon had charged Dunlap with perjury, witness intimidation, filing false documents and preparing false documents in a case that Dunlap had handled. Dunlap was acquitted on all charges but claims his reputation has been irreparably harmed as a result of the proceedings .Dunlap also discussed Sneddon’s frequent abuse of power and claimed that there are other lawyers who have seen this. A judge recently upheld most of Dunlap’s lawsuit and the case will soon go to trial. When Gary Dunlap was asked, in his intervuew, to comment on Jackson case, he said that he had no opinion one way or another on the case. However, he went on say, “…the very fact he’s being prosecuted by Sneddon’s office does not cause me to have any reason to believe that he’s guilty in that, because of what I know about the DA’s office, I know that do vindictive prosecutions on a routine basis.” If Dunlap’s allegations are true, then an investigation of the DA’s office might shed new light on the Jackson case.

Montadon case
July 17, 2004.The State Bar of California is investigating a complaint made by former Santa Maria City Attorney Art Montandon alleging that Santa Barbara County District Attorney Tom Sneddon and two other prosecutors obstructed justice in a 2003 prostitution case. Montandon said he filed his complaint in May, and it was recently assigned an investigator. (…)M ontandon/s complaint also alleged misconduct by Assistant District Attorney Christie Stanley and Deputy District Attorney Kimberly Smith. (…)The state attorney general/s office this week rejected a similar complaint made by Montandon against county prosecutors, Stanley said. Earlier this year, the district attorney/s filed its own complaint to the State Bar, alleging that Montandon interfered with the same prostitution case. No findings have yet been made in that case. (…)The district attorney/s office claimed Montandon proposed dropping prostitution charges against two Santa Maria sisters 7 April and Irene Cummings 7 in exchange for a video allegedly depicting former Police Chief John Sterling entering or exiting the women/s massage business. As city attorney, Montandon had no official authority to drop charges filed by the district attorney/s office, and his alleged deal for the supposed tape was called a possible “bribe” in the investigation. Montandon has repeatedly denied any wrongdoing in the matter, and in his claim accuses the district attorney/s office of obstructing an investigation he was conducting for Santa Maria. He filed a claim June 28 against Santa Barbara County, alleging that staff at the district attorney/s office engaged in a “conspiracy” to harm his reputation by distributing copies of the court documents to his co-workers and the media. County officials have 45 days to respond to Montandon/s claim, and have yet to do so. “We/re geared up to file a federal court lawsuit in the next two months,” said Montandon, who retired from Santa Maria June 30 and now works as legal counsel and assistant general manager for the Cambria Community Services District. Earlier this year, county prosecutors filed a report with the attorney general/s office requesting that agency prosecute the case against Montandon because of a perceived conflict of interest. Cruz case
In 2001 a man named Efren Cruz filed a federal lawsuit against Santa Barbara prosecutors accusing them of negligence and conspiracy to keep him in prison for 4 years despite being innocent ( the real murderer was caught later). The lawsuit also accused District Attorney Tom Sneddon of malicious prosecution. Allegedy, the prosecutors withheld evidence that would exonerated Cruz. The evidence was the rael killer’s secretly taped confession. The lawsuit was settled out of court at taxpayer’s expense, for an undisclosed but certainly substantial amount.

Wagener case
William Wagener ran for 5th District County Supervisor in 2002 and was arrested shortly before the election. Because he was a convicted felon, Wisconsin authorities claimed that he had no right to run for political office.
In response, Wagener’s attorney John Holland said that his client’s prior conviction should have had no effect on his right to be a political candidate. He also said that because the terms of Wagener’s probation had been given to the SBPD in 1998, authorities were already aware of his record when they allowed him to run for office.The charges against Wagener were dropped and he was released from jail. Still, his attorney accused Sneddon’s office of making sure Wagener was: “defamed and ridiculed in the local media in order to destroy his campaign for public office.” Wagener filed a lawsuit against the city of Santa Maria, Santa Barbara County and former Police Chief John Sterling, accusing them of violating his civil rights.
The lawsuit alleges that Police Chief John Sterling “had actual, advance knowledge of the plan by other defendants to falsely arrest, inaccurate and violate (Wagener’s) California and Federal civil rights.” Wagener claimed that authorities conspired against him because they wanted his opponent Joe Centeno to win the election.

The investigations concluded that complaints of molestation had been unfonded. He failed to mention that the Santa Barbara Children’s Service and Santa Barbara law enforcement had conducted similar investigations and had come to similar conclusions.
Sneddon took photographs of the office of a private investigator employed by Jackson and may have met with the accuser’s mother on at least one other occasion. It os highly irregular that these activities were undertaken without the presence of the police or investigators, and adds credence to the idea that Sneddon is not impartial enough to prosecute the Jackson case. He have Intentionally violated Jackson’s attorney-client privilege by breaking material clearly marked “Mesereau” (the surname of Jackson’s defense attorney).
Sneddon has consistenly used the media to sway public opinion against Jackson. The televised scene of the radi on Nov. 18,2003 on Jackson’s Neverland Ranch would have been more worthy of raid on the home of a serial killer than on the home of an entertainer with no prior police record.
During the raid, Sneddon allowed the police to go into areas that had not been authorized to enter and take items that were not on the search warrant and confiscated documents that had nothing to do with the case.
He tipped off Court TV reporter Diane Dimond about the raid and reported the live from Neverland. The tone of the press conference following the raid was inappropriately gleeful. Sneddon later apologized for his levity, but subsequently he referred to Jackson as “Jacko Wacko” in an interviewwith Dimond.
While working for the tabloid news show Hard Copy in September 1993, Dimond interviewed freelance journalist Victor Gutierrez who claimed that a new investigation centered on Michael Jackson had begun surrounding a videotape of Jackson molesting a boy . The allegation was later proven untrue . Jackson subsequently filed a $100 million slander lawsuit against Dimond, Paramount Pictures Corp (producer of Hard Copy), KABC-AM and Gutierrez. The suit was eventually won by Michael Jackson, but only against Guttierrez who was the source where the lie originated. All those who repeated and promoted the lie got away with it while Guttierez had to flee from the US in order not to pay the $2,7 mln. awarded to Jackson. Diane Dimond managed to escape justice after getting help from no other than Tom Sneddon, who made some misleading official declaration concerning the case .
He utilized an excessive number of search warrants (over 105).
Three million dollar: Jackson’s bail was three times that of the average murderer and nearly fifty times that of the bail schedule for the alleged crimes.
He intimidated witnesses at the grand jury hearing.
Tossing in a conspiracy charge while not indicting the other five alleged co-conspirators.
He checked the alleged past “abuses” and changed the californian rules so in order to bring them into the 2005 trial or allow third parties to testify on behalf of some fake victims.
Lying to the media and the general public about the actual nature of the two grand juries that were called in 1993-94. While Sneddon insisted that neither were asked to indict Jackson, blaming collapse of the case on the fact that Jackson had settled with the Chandler family, both grand juries could have returned indictments. Based on the flimsy evidence, however, both grand juries wisely decided not to do so.
Inappropriately interjecting himself into the case as a witness during grand jury testimony. He made himself a witness and was summarily examined by Tom Mesereau at a later hearing.
Sneddon fabricated false evidence against the singer: a set of fingerprint on a Barely Legal Magazine that did not exist until more than 5 months after Arvizo ( Jackson’s accuser) admitted he was last at Neverland , star’s ranch. Prosecutor the encouraged Arvizo to testify against Jackson and to state on the record that Jackson gave him that specific magazine, which was impossible because it had not been printed until many months later. Sneddon gave also the specific magazine to Arvizo at the secret Gran Jury indictment hearing without any gloves on and afterward sent it out for fingerprint analysis.
Moreover, the prosecutor’s office fabricated also false evidence on dates of phone calls to make it appear that Jackson may had made some phone calls.
In the courtroom the prosecution witnesses turned out to be not credible, and the trial was based only on Sneddon’s hatred towards Jackson and the DA was driven more by a obsession than a search for the truth. :

On August 14, 2012, an Conty Supervisor who was in the courtroom, W. Wargener presented an affidavit to the County Supervisors of Santa Barbara about criminal conduct commited by Sneddon during the 2005 trial of Mr. Jackson:
The information written here reveal false arrests, false imprisonments, condoning of excessive force by the police, tampering with evidence, and multiple civil rights violations that suggest a culture of corruption among Santa Barbara law-enforcement in those years. Chi era Tom Sneddon?

Sabato 27 Ottobre è morto Tom Sneddon, l’ex procuratore distrettuale conosciuto per aver perseguito la pop star Michael Jackson in due occasioni: nel 1993 e nel 2005.

ma il caso 2005 è andato a processo, ed ha attirato l’attenzione internazionale. Il 13 giugno 2005 la giuria ha trovato Jackson non colpevole verso tutte le accuse.
Riportiamo qui alcuni aspetti inquietanti, per non dire altro, della carriera da procuratore di Sneddon.
Il caso Sundaram
Il 30 aprile 2004, lo stesso giorno in cui è stato sigillato l’atto d’accusa contro Jackson, ci fu un altro evento, molto meno pubblico, uno che avrebbe potuto avere un impatto futuro sul caso Jackson. Gravi accuse di abusi tra l’applicazione della legge e l’ufficio del procuratore distrettuale di Santa Barbara, tra cui il procuratore distrettuale Tom Sneddon, sono state fatte dal dentista diella Contea di Santa Barbara, Thambiah Sundaram. Il contezioso tra Sundaram e le autorità di S.Barbara è iniziato quando Sundaram ha aperto una clinica odontoiatrica no-profit, raggiungendo in seguito un determinato status politico.
Dopo aver cercato invano di far chiudere la clinica le autorità di S.Barbara hanno arrestato Sundaram per furto , per aver impersonificato un medico e per aver compiuto atti malvagi. Anche sua moglie e un dipendente furono arrestati per aver commesso una sparatoria in auto.
Tutti è tre sono risultati NON colpevoli . Sundaram ha citato Sneddon ed i suoi collaboratori per cospirazione, falso imprigionamento e diverse violazioni dei diritt icivili. Gli sono stati assegnati quasi $ 300.000 per risarcimento danni.
Sundaram ha anche partecipato ad una cena di raccolta fondi privati nel 1994, dove Tom Sneddon e altri funzionari del governo avrebbe discusso i loro piani pe sbarazzarsi di alcuni individui a Santa Barbara che possedevano notevoli quantità di terra. Durante di questo incontro si è parlato anche della proprietà di Michael Jackson ; Sundaram ha affermato che le autorità volevano acquistare Neverland per i vigneti. Commenti razzisti sarebbero stati fatti in quell’occasione. Secondo Sundaram, furono discussie altre presunte vendette, nella misura in cui ha detto assomigliavano a una sessione di pianificazione mafiosa.
Il caso Dunlap
Le accuse di Sundaram non sono un caso isolato. Ci sono state molte denunce e cause legali contro il Procuratore Sneddon dell’ufficio del Santa Barbara . I capi d’accusa contro Jackson possono essere coerenti con un modello che l’avvocato difensore Gary Dunlap ha chiamato “oneri di accatastamento.” In un’intervista su MJJF Talk Radio, il 2 gennaio del 2004, Dunlap ha dato il suo parere circa “gli oneri di accatastamento” : era una pratica comune dell’ufficio del procuratore distrettuale, e ha sostenuto che si trattava di una tattica usata contro di lui. Nel Novembre 2003 ha depositato una querela di 10 milioni contro Tom Sneddon accusandolo di raket , testimonianza manipolate , cospirazione , azioni penali dolose.
Sneddon aveva accusato Dunlap per intimadazione dei testimoni , archiviazione e diffusione di documenti falsi nel acso da lui trattato.
Dunlap è stato assolto da ogni accusa , ma sotiene che comunque la sua reputazione è stata irrimediabilmente rovinata a seguito di quel procedimento.
Dunlap ha denunciato il frequente di abuso di potere da parte di Sneddon , sostenendo che anche altri legali confermano. Il giudice ha confermato gran parte delle querele di Dunlap , e il caso andrà presto in giudizio. Quando a Gary Dunlap è stato chiesto, nella sua intervista, di commentare il caso Jackson, ha detto che non aveva alcuna opinione.Tuttavia, ha continuato a dire: “… Il fatto stesso che su di lui è in corso un’azione dell ‘ufficio di Sneddon non mi dà alcun motivo di credere che lui è colpevole in quanto, a causa di quello che so l’ufficio del procuratore distrettuale, fa azioni penali vendicative di routine. “

Il caso Montadon
17 luglio 2004. Lo Stato della California sta indagando su una denuncia presentata dall’ex procuratore di Santa Maria Montandon relativo al fatto che il DA della Contea di Santa Barbara, Tom Sneddon, e altri due pubblici ministeri avrebbero ostacolato la giustizia in un caso di prostituzione del 2003 . Montandon ha detto che ha presentato la sua denuncia in maggio, ed è stato recentemente assegnato un investigatore.(…) La denuncia di Montandon è anche sulla presunta cattiva condotta dell’ assistente procuratore distrettuale Christie Stanley e del vice procuratore distrettuale Kimberly Smith. (…)L’ufficio del procuratore generale dello stato di questa settimana ha respinto una denuncia simile fatta da Montandon contro i procuratori della contea, ha detto Stanley. All’inizio di quest’anno, il procuratore distrettuale ha depositato la propria denuncia sostenendo che Montandon ha interferito con lo stesso caso di prostituzione. Non ci sono ancora stati risultati circa questo caso.(…). L’ufficio del procuratore distrettuale ha affermato che Montandon ha proposto di far cadere le accuse di prostituzione nei confronti di due sorelle di Santa Maria – Aprile e Irene Cummings – in cambio di un video che presumibilmente raffigura l’ex capo della polizia John Sterling entrare o uscire da un centro massaggi femminile. Come avvocato della città, Montandon non aveva alcuna autorità ufficiale far cadere le accuse presentate da ufficio del procuratore distrettuale, e il suo presunto affare per il nastro presunto è stato chiamato un possibile “tangente” nelle indagini. Montandon ha ripetutamente negato ogni accusa in materia, e nella sua pretesa accusa l’ufficio del procuratore distrettuale di ostacolare un’inchiesta che stava conducendo per Santa Maria. Ha presentato una rivendicazione 28 giugno contro la contea di Santa Barbara, relativa al fatto che il personale presso l’ufficio del procuratore distrettuale si è impegnato in una “cospirazione” per danneggiare la sua reputazione attraverso la distribuzione di copie dei documenti del tribunale per i suoi collaboratori e dei media. I funzionari della contea hanno 45 giorni per rispondere alla richiesta di Montandon, e devono ancora farlo. “Siamo pronti a presentare una querela al tribunale federale nei prossimi due mesi”, ha detto Montandon, che si è ritirato da Santa Maria il 30 giugno e ora lavora come consulente legale e assistente direttore generale per la Cambria Community Services District. All’inizio di quest’anno, i procuratori della contea hanno presentato un rapporto all’ l’ufficio del procuratore generale chiedendo ad un’agenzia di perseguire il caso contro Montandon a causa di un conflitto di interessi. Il procuratore generale ha respinto la richiesta, aprendo la strada per i procuratori di sporgere denuncia contro Montandon. Finora, non l’ hanno fatto.

April Cummings ha sostenuto in un’ udienza che Sneddon era un cliente della sua attività di massaggi ormai defunta, i cui Pubblici Ministeri dicono essere coinvolta nella prostituzione.

Il caso Cruz
Nel 2001 un uomo di nome Sues Cruz ha intentato una causa federale contro i Procuratori di S.Barbara , accusandoli di negligenza e cospirazione per averlo tenuto in carcere per 4 anni pur essendo innocente (il vero assassino è stato catturato in seguito).
L’azione federale è stata intentata anche contro il Procuratore Tom Sneddon per processo doloso. Presumibilmente, i pubblici ministeri avrebbero trattenuto prove che avrebbero scagionato Cruz. La prova è stata la confessione segretamente registrata del vero killer. La causa è stata risolta in via extragiudiziale a spese dei contribuenti.

Il caso Wagener
Nel 2002 William Wagener era candidato alle elezioni come Supervisore del 5°Distretto. Venne arrestato prima delle elezioni perchè , secondo le autorità del Wisconsin era un criminale , e per tanto non aveva il diritto di partecipare allle elezioni.
Secondo la documentazione presentata dal legale di Wagener le autorità erano a conoscenza della situazione di Wagener dal 1998 , quindi anche quando gli hanno dato il permesso di candidarsi alle elezioni.
Le accuse contro Wagener sono cadute ed è stato scarcerato. Il legale Wagener ha affermato che lo scopo era stato era stato quello di diffamare e ridicolarizzare il suo cliente attraverso i media locali al fine di distruggere la sua campagna per una carica pubblica. Wagener ha intentato una causa contro la città di Santa Maria, la contea di Santa Barbara e l’ex capo della polizia John Sterling, accusandoli di aver violato i suoi diritti civili.
Nell’azione legale si sostiene che il capo della polizia John Sterling era a conoscenza del piano con gli altri imputati. Wagener ha affermato che le autorità hanno cospirato contro di lui perché volevano che il suo avversario Joe Centenoper vincesse le elezioni.
Il caso Jackson
Durante il caso Jackson Sneddon ha commesso molti più abusi:
in seguito alla presentazione di accuse, il 18 dicembre nel 2003, Sneddon ha sommariamente respinto le indagini del Dipartimento di Polizia di Los Angeles, del Dipartimento di Bambini e dei Servizi per la Famiglia su Jackson. Le indagini avevano concluso che le denunce di molestie erano infondate. Ha omesso di menzionare anche che i Servizi dei bambini di Santa Barbara e le forse dell’ordine di Santa Barbara avevano condotto indagini simili ed erano arrivati a conclusioni simili.
Sneddon ha preso delle fotografie dalla sede di un investigatore privato alle dipendenze della pop star, e potrebbe aver incontrato la madre della accusatore in almeno un altra occasione. E’ molto irregolare che queste attività siano state effettuate senza la presenza della polizia o degli investigatori, e aggiunse credito all’idea che Sneddon non è abbastanza imparziale per perseguire il caso Jackson. Ha violato il privilegio avvocato-cliente di Jackson prendendo materiale che aveva chiaramente la dicitura “Mesereau” (il cognome dell’ avvocato difensore di Jackson).
Sneddon ha costantemente utilizzato i media per influenzare l’opinione pubblica contro Jackson. La scena televisiva del raid del 18 novembre 2003 al Neverland ranch di Jackson sarebbe stata più degna di un raid contro la casa di un serial killer che sulla casa di un artista che non abbia un’attività di polizia preventiva. Durante il raid, Sneddon permise che la polizia andasse in aree in cui non era stata autorizzata a entrare e prendesse oggetti che non erano sul mandato di perquisizione ed ha confiscato documenti che non avevano niente a che fare con il caso.
Ha fatto una soffiata in TV alla giornalista Diane Dimond circa il raid e ha riportato l’evento in diretta da Neverland. Il tono della conferenza stampa dopo il raid era impropriamente allegro. Sneddon ha poi chiesto scusa per la sua leggerezza, ma successivamente si è riferito a Jackson come “Wacko Jacko” in un’intervista con la Dimond.
Mentre lavora per il telegiornale tabloidHard Copy (1993) Dimond intervistò il giornalista freelance Victor Gutierrez, il quale sostenne che da una nuova indagine centrata su Michael Jackson era emersa una videocassetta di Jackson mentre molestava un ragazzo. E’ stato poi dimostrato che tale affermazione era falsa. Jackson successivamente depositò una causa di 100 milioni di dollari per calunnia contro Dimond, la Paramount Pictures Corp (produttore di Hard Copy), KABC-AM e Gutierrez. La causa fu poi vinta da Michael Jackson, ma solo contro Guttierrez che era la fonte da cui la menzogna ha avuto origine. Tutti coloro che avevano ripetuto e promosso la menzogna la fecero franca mentre Guttierez fuggì dagli Stati Uniti al fine di non pagare i $ 2,7 milioni a Jackson. Diane Dimond riuscì a sfuggire alla giustizia dopo aver ottenuto l’aiuto di Tom Sneddon, che fece qualche dichiarazione ufficiale fuorviante in merito al caso.
Ha utilizzato un numero eccessivo di mandati di perquisizione (oltre 105).
Tre milioni di dollari: la cauzione di Jackson è stato tre volte superiore a quella media per un assassino e quasi cinquanta volte superiore a quello del programma di cauzione per i presunti crimini.
Ha intimidito dei testimoni durante l’udienza con il Gran Jury.
Ha lanciato l’accusa di cospirazione senza incriminare gli altri 5 presunti co-cospiratori
Ha controllato i presunti “ abusi” del passato e ha modificato la normativa in modo da poter portare quei casi nel processo del 2005 o permettere a terze parti di testimoniare per conto di alcune vittime fittizie
Bugie ai media e all’opinione pubblica circa la natura effettiva dei due Gran Jury chiamati nel 1993/94. Mentre Sneddon insisteva sul fatto che a nessuno dei due era stato chiesto di incriminnare Jackson, attribuendo la chiusura del caso al fatto che Jackson si fosse accordato con l’accusatore, entrambi i Gran Jury avrebbero potuto riviarl a giudizio. In realtà, sulla base delle prove inconsistenti entrambi decisero saggiamente di non farlo…
Ha testimoniato lui stesso ed è stato sommariamente esaminato da Tom Mesereau nel corso di un’udienza successiva.
Ha fabbricato prove false contro il cantante: una serie di impronte digitali su una rivista che non esisteva se non 5 mesi dopo rispetto all’ultima visita di Arvizo (l’accusatore di Jackson) a Neverland, il ranch della star. Il procuratore ha incoraggiato Arvizo a testimoniare contro Jackson e di indicare a verbale che Jackson gli aveva dato quella specifica rivista, il che era impossibile perchè fu stampata mesi dopo. Sneddon ha anche fatto maneggiare la rivista ad Arvizo durante l’udienza del Gran Jury senza guanti e poi l’ha inviata per l’analisi delle impronte digitali.
L’ufficio del procuratore fabbricò prove false anche riguardo le date di alcune telefonate per far sembrare che Jackson avesse fatto certe telefonate.
In aula i testimoni dell’accusa si rilevarono non credibili, e il processo era basato solo su l’odio di Sneddon nei confronti di Jackson; il procuratore era mosso più dalla sua ossessione che dalla ricerca della verità:

Le informazioni scritte qui rivelano falsi arresti, falsi imprigionamenti, eccessivo uso della forza da parte della polizia, inquinamento delle prove e molteplici violazioni dei diritti civili che suggeriscono una cultura della corruzione tra le forse dell’ordine e la procura di Santa Barbara all’epoca. Nel web circolano anche altri nomi: l’elenco delle azioni illegali di Sneddon potrebbe continuare a lungo, ci sono stati altri casi civili contro di lui di cui il pubblico non è a conoscenza perché concordati in sede extragiudiziale, ma abbiamo deciso di farla finita qui.
