IL RESOCONTO DI WAGENER DAL TRIBUNALE

Questa mattina, l'udienza ha avuto EFFETTIVAMENTE luogo, con Howard Weitzman che è arrivato tardi e il giudice Beckloff che è uscito e ha preso posto sul banco appena è arrivato Howard.
Howard W. ha annunciato che era lì a rappresentare l’ESTATE di MICHAEL JACKSON, [insieme ad altri 3 avvocati], si è seduto e ha lasciato che fosse un avvocato più giovane a parlare per loro.
L'avvocato più giovane ha fatto un buon lavoro, ma non l’ho mai sentito dire: “MJ era assolutamente incapace di molestare, stuprare o fare del male a un bambino”, come disse MJ stesso in un video ben noto. Invece, la sua argomentazione è stata sui tempi di scadenza, che ci sono per una ragione valida. Ha detto che gli avvocati di Robson, Gradstein e Marzano, stanno fondamentalmente cercando di riscrivere la legge, in modo da
poter procedere con il caso, che è stato presentato troppo tardi.

Robson non era presente. Ma avrebbe potuto esserci. Anche Michael Jackson NON era personalmente presente in carne e ossa, essendo stato dichiarato legalmente morto dal medico legale di LA 6 anni fa. La differenza è che Michael non poteva essere lì, anche se lo avesse voluto, e ho seri dubbi che MJ da quando licenziò John Branca e il suo studio legale, abbia mai immaginato che Weitzman e Branca e il loro studio legale sarebbero stati lì a rappresentarlo per un’accusa di presunte molestie 5 anni dopo il suo funerale, presentata anni dopo il limite temporale fissato per presentare QUALSIASI reclamo.
E’ anche particolarmente strano che io ho visto personalmente ROBSON testimoniare nel 2005 nel caso fasullo degli Arvizo. Interrogato dal procuratore Auchincloss, che gli chiese se magari era possibile che lui stesse dormendo mentre MJ lo molestava, Robson rise e disse, "Penso che mi avrebbe svegliato" o qualcosa del genere. Io ero in aula ad ascoltarlo e a osservare il linguaggio del corpo di Robson, lui stava dicendo la verità nel 2005. Aveva avuto mesi di tempo per pensarci ed era addirittura venuto dall'Australia a testimoniare PER Michael Jackson.
La legge è chiara. Si deve presentare un QUALSIASI reclamo contro l’ESTATE di un deceduto entro un certo limite temporale, che era scaduto da un bel po’ quando nel maggio 2012, Robson, a corto di denaro facile, è stato convinto dal suo Medico forense ______, che lui non ha riconosciuto l'abuso come ABUSO. Strano che sui documenti non compaiano i nomi dei medici. I nostri tribunali stanno diventando sempre più “Camere per Star”.
Marzano ha insistito molto sull’allungamento dei termini per la scadenza e ha sostenuto il suo "Fatto #" questo e quest’altro. Dopo l’udienza, io, Pearl Jr e Twiggy siamo andati a chiedere quel documento del 7 aprile con questi presunti “fatti” e la prima cosa che ho notato è che il nome dello psicologo forense è stato oscurato. Quindi non possiamo neanche controllare per vedere cosa mostra il curriculum di questo strizzacervelli “professionista”. E’ come se una donna sostenesse di essere stata violentata e che il dottor _____ sia stato un testimone oculare. Senza nominare il "testimone" o il medico, è solamente un HEARSAY (testimonianza indiretta). E un HEARSAY non è ammissibile in tribunale.
Oltre a quell’ovvia palese omissione, il giovane avvocato dell’ESTATE di MJ ha mancato di sottolineare questo, argomentando invece che nel 15 ° secolo il re Enrico confiscò il patrimonio di un nobile perché suo nonno aveva commesso tradimento! Il punto era che la "responsabilità" non può seguire la "proprietà" per un periodo di tempo senza fine.
Penso che l’ESTATE abbia sostenuto un punto valido. Se i termini possono essere allungati fino a questo punto... allora non avrà più senso alcun termine.
L'avvocato di Robson ha aggiunto che una "nuova legge viene fatta ogni anno”.
Il giudice Beckloff ha cercato di dare agli avvocati dell’Estate l’ultima battuta, cosa che però portava i legali di Robson a rimarcare continuamente la loro posizione, e la cosa è andata avanti così… ma il punto fondamentale è che il giudice Beckloff ha detto che avrebbe emesso una sentenza in un "paio di giorni".
L’udienza era finita alle 09.40. Ma nel corridoio Howard Weitzman sembrava molto felice e con un gesto più che amichevole ha preso per un braccio l’avvocato di Robson, come vedete nella fotografia scattata da Twiggy. Howard era molto compiaciuto e anche felice. Quando gli ho chiesto: "questo è stato l’atto finale?" ha borbottato indistintamente, perciò ho chiesto all'avvocato di Robson, Maryann Marzano, che mi ha detto che se il giudice si pronuncerà a favore dell’Estate "noi faremo appello", e se perderanno l’appello, ne faranno un altro alla Corte Suprema dello Stato della California e se Robson dovesse perdere anche lì... procederanno con la Corte Suprema degli USA.
La mia sensazione è che questo sia solo un modo per sporcare l’eredità di MJ e sottrarre valore al suo messaggio, che era: "Heal the World, make it a better place". Ma se loro fanno appello alla Corte Suprema degli Stati Uniti, questo si traduce in più soldi per gli avvocati dell’Estate nel pagare loro stessi e... se poi dovessero finire a fare un accordo, TUTTI gli avvocati sarebbero pagati dall’ESTATE di MJ.
Le accuse sono ridicole ed è ancora più ridicolo che siano state presentate oltre i limiti. Thomas "HURRICANE" Mesereau sa come vincere un caso. Non posso evitare di pensare che se l’Estate avesse affidato questa difesa a "Hurricane" Mesereau, il caso sarebbe già stato sepolto insieme a tutti gli altri casi fasulli.
Non posso fare a meno di chiedermi chi è che pagherà le spese legali di Robson.

W. Wagener's report from Court: This Morning, the hearing ACTUALLY happened. with Howard Weitzman arriving last, and Judge Beckloff came out and took the Judges Bench as soon as Howard arrived. Howard W. announced he was here to represent the ESTATE of MICHAEL JACKSON, [along with 3 other attorneys], and he sat down and let a younger attorney present their side. The younger attorney did a fair job of arguing, but i never heard him say, MJ was incapable of molesting, raping or injuring a child, as MJ himself said in a well known video. Instead, he argued the Statue of Limitations are there for a valid reason. And that Robson's attorneys, Gradstein & Marzano were basically trying to re-write the law, so
they could go ahead with the case, which was filed too late.
Equitable Estopple and Privity. Discussed a lot. Robson was not present. But he could have been. Michael Jackson also was NOT personally present, in the flesh, having been declared legally dead by the L.A. Cornoner almost 6 years ago. The difference is Michael could NOT be there, even if he wanted to be, and I have grave doubts that MJ ever since firing John Branca & that law firm, ever dreamed Weitzman & Branca & firm would ever be representing Michael, 5 years after his public funeral with a claim of alleged "molestation" years after it was too late to file ANY Claim.
It is particularly weird, also, that I personally saw ROBSON testify in 2005 in the bogus Arvizo case, that MJ never molested him, Robson. And when asked by prosecutor Auchincloss, asked Robson if maybe Robson was sleeping when MJ molested him. Robson laughed and said, "I think that would have woke me up" or words to that effect. I was in the courtroom watching Robson's body language and words, and he was telling the truth in 2005. He had months to think about it, and even came from Australia to testify FOR Michael Jackson.
The Law is clear. You must file your claim for ANY thing against the decedents ESTATE in a limited time, and it was long past when in May 2012, Robson, running out of easy money was persuaded, by his forensic Dr. ______, that he just did not recognize the abuse as ABUSE. Weird the documents do not reveal the doctors name. Our courts are becoming "Star Chamber" events.
Marzano, tried really hard to stretch the Statute of Limitation, and argued her "Fact #" this and that. After the hearing Pearl jr., Twiggy & I went and got that April 7th filing with the alleged "facts". And first thing I noticed is the forensic Psychologist name was blanked out. So we can not even check to see what this "professional" head shrinker's past record performance shows. This is like a woman claiming she was raped and Dr. _____ was an eye witness. Without naming the "witness" or doctor, its just HEAR say. And Hearsay is NOT admissible in court.
Other than that blatant obvious omission, ESTATE of MJ young attorney failed to point that out, but other wise made a argument that in the 15th century King Henry confiscated a nobleman's Estate, because his grandfather had committed Treason! Point was, the "Liability" can not follow the "property" for an endless length of time.
I think the ESTATE argued valid point. If this statute of Limitations can be stretched this far… then there will be NO STATUE of LIMITATIONS.
Robson's attorney added, "New law is made" every year.
Judge Beckloff tried to give the Estate Attorneys the "last bite of the apple", but Robsons attorney remarked again, which triggered Estate Attorney memory, on and on…
bottom Line,
Judge Beckloff said he would issue a ruling in a "couple of days".
Court was over by 9:40 am on Tuesday. But in the Hall way Howard Weitzman, seemed very happy and in a friendlier than most, gesture, grabed the male Attorney for Robson, and Twiggy, could it on camera see below. Howard was very pleased. and even happy. When I asked him if "this was the end of it?" he mumbled indistinctly, so I asked Robson's attorney Maryann Marzano, she said, if Judge ruled in favor of the Estate, "we will appeal", and if she lost appeal , she would appeal to the State Supreme Court, and if Robson lost there…. on and on to the "U.S. Supreme court."
MY gut feeling is that this is just to dirty my MJ legacy, and diminish his message, which was to "Heal the World, make it a better place". But if they appeal it to the US Supremes, that is more money for the Estate Attorneys to pay themselves, and … if they SETTLE out of COURT then ALL attorneys will get paid from the ESTATE of MJ.
The allegations are ridiculous, and the late filing is even more ridiculous. Thomas "HURRICANE" Mesereau knows how to win a case. I can not help feeling that if the Estate Attorneys had outsourced this defense to "Hurricane" Mesereau, this case would already have been buried with all the other bogus cases.
I can not help wondering who is going to be paying Robson legal fees.

Try to find a picture with Mr. Mesereau giving a big smile to Tom Sneddon or with Mr. Panish to Mr. Putnam. You're going to fail because there's no such a picture like this one just taken in Court where Howard Weitzman is grabbing the arm of the man who is opposing counsel with a big smile on his face. Do you know the reason of his smile ? It's the awaraness of being all WINNERS in this case that's MONEY for ALL of them. The only one who's harmed by their LIES is Michael Jackson, as usual. The Judge has not ruled yet, he said he's going to make a decision in a few days. More time to drag Michael's name through the mud!

Provate a trovare una foto di Mesereau che sorride così a Sneddon o di Panish a Putnam. Non la troverete perché non esiste una foto simile a questa appena scattata in tribunale dove Howard Weitzman tiene il braccio dell'avvocato della parte avversaria con un bel sorrisone stampato in faccia. Sapete cos'è quel sorriso? La consapevolezza che sono tutti VINCITORI in questo caso che significa SOLDI per TUTTI loro. L'unico danneggiato dalle loro BUGIE è Michael Jackson, come al solito. Il giudice non ha ancora emesso la sua sentenza, ha detto che prenderà una decisione entro pochi giorni. Ancora più tempo per gettare il nome di Michael nel fango!
